Information for Data Subject with regard to Personal Data Protection

In terms of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 with regard to the processing of personal data and on the free movement of such data and repealing Directive No. 95/46 EC (hereinafter referred to as the “Regulation”) the Company acts as controller of the personal data of the natural persons with whom the Company has been in contractual relationship and who are deemed to be data subjects in terms of the Regulation (hereinafter referred to as the “Data Subject(s)”).

General guidance

The Company processes the Data Subject's data in particular for the purpose of pre-contractual negotiations and for the purpose of exercising rights and fulfilling duties in connection with the contractual relationship made between the Company and the Data Subject.

The legal basis for the processing of the Data Subject's personal data involves the necessity of processing for the following purposes:

- fulfilment of a legal obligation imposed on the Company (in particular tax and accounting administration) and also dealing with customer's warranty claims;
- performance of the agreement made between the Company and the Data Subject;
- the legitimate interests of the Company.


The legitimate interest of the Company is the exercise of the right to protection of property against unlawful action of third parties and protection of the property and health of employees and visitors to the Company's premises.

The recipients of the Data Subject's personal data may include:

- the state administration authorities exercising powers in financial administration;
- an external entity processing accounting and tax paperwork, an IT administrator or tax and legal advisors;
- third parties for the purpose of handling complaints raised by the Data Subject.


The personal data will be processed by the Company manually and automatically and the personal data may be processed by a third party, i.e. a processor by virtue of an instruction given by the Company in its capacity as personal data controller. The personal data will be accessed by the Company's appointed employees and also by an external entity processing accounting and tax paperwork, the IT administrator or (as the case may be) tax and legal advisors who will receive the personal data only to the necessary extent and are bound by the statutory confidentiality obligation.

The criteria for determining the time of storage of the Data Subject's personal data by the Company are as follows:

- the date of settlement of all claims arising from the contractual relationship between the Company and the Data Subject, or
- the date of expiry of the period over which the Company is obliged to retain/archive personal data or documents containing them pursuant to the relevant provisions of legal regulations,


whichever of them occurs later.

Sending commercial offers

Unless the Data Subject rejects sending of offers when contact details are provided or at any time later, the contact details may be used for sending offers by e-mail, text message or by any other electronic means. Such offers will concern products and services sold and offered by the Company. One can reject the sending of the offers.

Special guidance on running camera system

In compliance with the relevant provisions of the Regulation and within the scope below said, the Company hereby informs the Data Subject of running a camera system on the specific premises of the Company.

The main purpose of running the camera system and making recordings is to protect the Company's rights and the interests protected by law (general protection of the Company's property, protection against theft and abuse).

Rules of running camera system

a. Individual cameras are located at the offices of the sales department and on storage premises at the Company's registered office address.
b. Camera system recordings made to monitor consignments dispatched are retained by the Company for the period between the dispatching of the consignment and the time of delivery of the consignment to the customer, however, within no more than 14 days (delivery, as a rule, takes place earlier than within 14 days, nevertheless, the Company allows for a time reserve in case of any complications with delivery, e.g. failure by the delivering entity to reach the customer, etc.). Camera system recordings made outside the Company's business hours, i.e. those aimed against burglary of the premises, are retained for a maximum of 3 days.
c. All monitoring devices, including camera system recordings, are protected against access by unauthorized persons, against destruction or abuse of the entire system or recordings.
d. The camera system and the access to recordings may only be controlled by and provided to the Company's executives and also the external processor with whom a personal data processing contract is concluded, with the recording in case of an incident being only submitted to investigative, prosecuting and adjudicating authorities or the Company's insurer (unless relevant legal regulations provide or allow otherwise).
e. Electronic records shall be kept with regard to the access to the camera system recordings to allow and verify when, by whom and for what reasons the personal data have been recorded or otherwise processed.
f. The premises being monitored by the Company shall be designated with conspicuous notice displayed in or in front of the room being monitored.


Guidance as to Data Subject's rights

The Data Subject has the right:
- to request the Company to be allowed access to the personal data concerning the Data Subject;
- to request rectification, erasure or restriction to process the personal data concerning the Data Subject;
- to object to the processing of the personal data concerning the Data Subject;
- to portability of personal data concerning the Data Subject;
- to lodge a complaint with the Personal Data Protection Office, having its seat at Pplk. Sochora 27, Prague 7, Postcode: 170 00, ID No.: 708 37 627.
